Анотація

Автором статті проведено комплексний аналіз правового регулювання права власності на земельні ділянки в Україні. В межах дослідження розкрито зміст поняття земельної ді- лянки як об’єкта права власності за законодавством України та продемонстровано залежність та варіативність значення терміну «земельна ділянка» від контексту його використання.

Детально розглянуто специфіку змісту права власності на земельні ділянки: сутність книжного володіння та судової практики способів його захисту; обсяг права користування земельною ділянкою, що є обмеженим і обумовлюється її цільовим призначенням; режим здійснення права розпорядження щодо земельних ділянок.

Проаналізовано особливості та проблемні моменти набуття права власності на земельні ділянки різного цільового призначення та у різний спосіб. Розкрито суперечливість та недо- сконалість статей Земельного кодексу, що регулюють питання змісту угод, щодо переходу права власності на земельні ділянки. Автором статті небезпідставно поставлено під сумнів позицію судової влади з питань визнання угод неукладеними у випадку відсутності однієї чи більше з істотних умов договору. З аналізу чинного законодавства слідує, що сторони у подібних випадках могли не дотриматися належної форми закріплення істотної умови, а отже угода укладена, але у той же час є нікчемною.

Значну увагу приділено аналізу певної кількості проблемних питань суб’єктного складу у відносинах власності на земельні ділянки, а саме наявності пережитків радянської епохи. Автором детально досліджено форми власності на землю та проблемні питання, що існують у цій сфері. Розглянуто проблемні питання у реалізації права спільної сумісної власності на землю, у тому числі власниками багатокваритних будинків та наведено варіанти їх вирішення. Представлено особливості українського варіанту права довірчої власності на земельні ділянки, як способу забезпечення виконання зобов’язань.
