Перебудова законодавства про власність для демократичної ринкової системи: приклад Литви

Анотація

Основна сфера приватного права – приватна власність – розглядалася як головне соціальне зло в рамках комуністичного режиму. З цієї причини, за колишніх економічних умов, радянське право власності було зведене до карикатурної версії всеосяжного західного права власності. Після розпаду Радянського Союзу і падіння комунізму, економічно стресовим східноєвропейським країнам, включаючи Литву, довелося мати справу з радянською «спад- щиною» і широко реформувати свої правові системи, щоб полегшити економічний перехід до ринкової системи. Важливою частиною цього процесу була реформа права власності – правового наріжного каменю ринкової економіки. Хоча це було нелегко, але здебільшого успішно, і сьогодні литовська економіка, інтегрована в єдиний ринок ЄС, процвітає частко- во завдяки своєму законодавству про власність. У статті представлено досвід Литви у про- цесі перебудови законодавства про власність та описано його зміст. Перехідний процес, хоча в цілому і був успішним, включав кілька невдач, які створили певні системні проблеми, що відчуваються і донині. Однак проблеми, що залишилися, здаються набагато менш зна- чними порівняно з тими, які були вирішені протягом вирішального перехідного десятиліття, тому лише питання часу, коли литовська правова система, підтримувана постійним впливом європейської правової культури та національною рішучістю, впорається з ними.
