Abstract

The article provides a comprehensive disclosure of the essence of a relatively new method of ensuring the fulfillment of obligations – retention – and examines the issues related to its implementation.

Particular attention is paid to the question of what kind of things under the current Ukrainian legislation may be withheld by a creditor in order to encourage the debtor to fulfill its obligation properly, whether only movable or immovable. Consideration of the legal regime of things leads to the conclusion that both movable and immovable things may be subject to retention. The author also examines the diverse experience of other countries on this issue.

The author discusses the issue of «book possession» and the possibility of state registration of real estate retention. The author expresses the opinion that it is inadmissible to artificially restrict the implementation of security interest, which is a truly dispositive area of regulation, by narrow frameworks of tendentious doctrinal interpretation.

The author establishes that there is an obvious gap in the current civil legislation with regard to the retention of real estate, since it is unclear whether such retention can be registered and suggests ways to eliminate this negative
