Анотація

Статтю присвячено огляду процесу становлення вчення про іпотеку в історичному і порівняльному аспектах. Іпотеку розглянуто як економічну, фінансову та правову категорію. У перших двох випадках іпотека характеризується як фінансовий інструмент, здатний до обороту, і доводиться те, що це впливає на правову характеристику іпотеки. Актуальність тематики доводиться наявністю численних спорів та питань, що постали в судовій практиці за відсутності належного теоретичного осмислення феномену іпотеки в сучасних економічних та правових умовах. Для ілюстрації значущості цих проблем надано аналіз судової практики, завдяки застосуванню порівняльно-правового, історико-правового та формального методів стало можливим навести пропозиції щодо подолання практичних проблем та простежити зміни теоретичних засад і тенденцій розвитку вчення про іпотеку. Висвітлено питання державної реєстрації іпо- теки як обтяження права власності й права власності на обтяжене іпотекою майно. Наведено міркування про акцесорність та абстрактність іпотеки з позицій її зв’язку з основним зобов’язанням, забезпеченим іпотекою. У контексті правової характеристики вказано на поєднання речових та зобов’язальних засад іпотеки. Розглянуто правові позиції Верховного Суду з приводу захисту прав власника предмета іпотеки та добросовісного набувача
