Abstract

The publicity of security interests in movable property remains an important issue in private law, as the lack of effective registration increases risks for creditors and reduces the predictability of transactions. With the development of financial markets, there is a growing need to analyze foreign regulatory models. The study uses comparative legal, historical legal, formal legal, and systemic structural methods, as well as legal modeling, empirical analytical, and doctrinal approaches. The analysis revealed significant differences in approaches to the publicity of security interests in movable property: from the registration of limited categories of objects in Germany to comprehensive universal registries in the Western countries and some Eastern European countries. It has been established that the lack of a unified registration system leads to reduced transparency of collateral relationships and limits the availability of financing for a number of industries, including renewable energy. Based on a comparative analysis, a model for a possible unified register of security interests has been proposed, based on the principles of publicity, priority, and technological accessibility. The global trend shows a gradual expansion of registries, but harmonization in Europe is complicated by differences in national systems. Universal registries normally increase creditor protection but require institutional adaptation. The study showed the need to modernize the mechanisms for registering security interests in movable property, taking into account international experience. The proposed model of a universal registry could become the basis for further reforms aimed at increasing the transparency, predictability, and stability of financial transactions. The results obtained are of practical importance for legislators, legal practitioners, and financial market participants
